Beer Here USA, LLC (“BHU”) is committed to protecting your privacy. This Privacy Policy explains our information gathering and dissemination practices in connection with the services (“Services”) available via the Beer Here mobile application (the “Application”). 1. WHAT INFORMATION IS COLLECTED?

Account Information. If you create an Account, we’ll collect certain information that can be used to identify you, such as your email address, (“PII”). If you create an Account using your login credentials from one of your Social Networking Site (“SNS”) Accounts, we’ll be able to access and collect your name and other PII that your privacy settings on the SNS account permit us to access. If you create an account through the Services or one of your SNS accounts, we may also collect your gender, date of birth and other information that is not considered PII because it cannot be used by itself to identify you. Information Related to Use of the Services. Our servers automatically record certain information about how a person uses our Services (we refer to this information as “Log Data”), including both account holders and non-account holders (either, a “User”). Log Data may include information such as a User’s Internet Protocol (IP) address, browser type, operating system, the web page that a User was visiting before accessing our Services, the pages or features of our Services to which a User browsed and the time spent on those pages or features, search terms, the links on our Services that a User clicked on and other statistics. We use Log Data to administer the Services and we analyze (and may engage third parties to analyze) Log Data to improve, customize and enhance the Services by expanding their features and functionality and tailoring them to our Users’ needs and preferences. We may use a person’s IP address to fight spam, malware and identity theft. We also use the IP Address to generate aggregate, non-identifying information about how our Services are used. Information Sent by Your Mobile Device. We collect certain information that your mobile device sends when you use our Services, like a device identifier, user settings and the operating system of your device, as well as information about your use of our Services. Location Information. In some cases we may collect and store information about where you are located, such as by converting your IP address into a rough geolocation or by accessing your mobile device’s GPS coordinates or coarse location if you enable location services on your device. Location Information is necessary for the search function of our App and allows Users to find locations that are nearest them relevant to their search request. We may use location information to improve and personalize our Services for you. If you do not want us to collect location information, you may disable that feature on your mobile device.

2. USE AND DISTRIBUTION OF INFORMATION.

We use the information collected: To provide and improve the Service, complete your transactions, and address your inquiries, process your registration, verify the information you provide is valid and for compliance and internal business purposes; To contact you with administrative communications and BHU newsletters, marketing or promotional materials (on behalf of BHU or third parties) and other information that may be of interest to you. If you decide at any time that you no longer wish to receive such communications from us, please follow the instructions in the Options section, below; To provide the information that we believe in good faith is required to comply with the law, an order, or other process; and To enforce and comply with the law, including to conduct an investigation, to protect the property and rights of BHU or a third party, to protect the safety of the public or any person, or to prevent or stop activity we may consider to be, or to pose a risk of being, illegal, fraudulent, unethical or legally actionable activity.

3. DATA RETENTION.

BHU will retain user provided data and automatically collected information for as long as you use the Application and for a reasonable time thereafter. We will retain automatically collected information for up to 24 months and thereafter may store it in aggregate. If you’d like us to delete user provided data that you have provided via the Application, please contact us at info@beerhereusa.com and we will respond in a reasonable time. Please note that some or all of the user provided data may be required in order for the Application to function properly.

4. WITH WHOM THE INFORMATION MAY BE SHARED.

We will not share any PII that we have collected from or regarding you except as described below: Information Shared with Our Service Providers. We may engage third party service providers to work with us to administer and provide the Services. These third-party service providers have access to your PII only for the purpose of performing services on our behalf. We may also share your PII with our marketing service providers to help us better market our products and services to you. Our marketing service providers may use your PII only for the purpose of helping us better market our products and services to you and are prohibited from transferring your PII to others. If you don’t want BHU to use your information for these purposes, you can opt out by contacting us at info@beerhereusa.com Information Shared with Third Parties. We may provide your basic email information to third parties for marketing based on your selected preferences within the App. You may receive updates, notifications of events and giveaways from participating sponsored businesses. You may opt out of those communications at any time by following the opt out instructions contained within those email communications or by notifying us that you prefer not receive third party marketing communications by emailing us at info@beerhereusa.com and we will respond in a reasonable time. Information Disclosed for Our Protection and the Protection of Others. We cooperate with government and law enforcement officials and/or private parties to enforce and comply with the law. We may disclose any information about you to government or law enforcement officials or private parties as we, in our sole discretion, believe necessary or appropriate: (i) to respond to claims or legal process (including subpoenas, warrants or court orders); (ii) to protect our property, rights and safety and the rights, property and safety of a third party or the public in general; and (iii) to prevent or stop any activity we consider illegal, unethical or legally actionable activity. [Widgets. Our Application may include social media features, determined by BHU if we so choose to integrate those features, or interactive mini-programs. These features may collect your IP address, which page you are visiting on or Application, and may set a cookie to enable the feature to function properly. Social media features and widgets are hosted by a third party or hosted directly on our Application. Your interactions with these features are governed by the privacy statement of the company providing it.] Internal and Business Transfers. BHU may share information, including PII, with its subsidiaries, and affiliates, primarily for business and operational purposes. We may sell, transfer or otherwise share some or all of our assets, including your PII, in connection with a merger, acquisition, reorganization or sale of assets (including, in each case, as part of the due-diligence process with any potential acquiring entity) or in the event of bankruptcy. You will be notified via email and/or a prominent notice on our website of any change in ownership or uses of your personal information, as well as any choices you may have regarding your personal information.

5. CHILDREN UNDER THE AGE OF 13 YEARS.

In accordance with the Children’s Online Privacy Protection Act (COPPA), BHU will not knowingly collect or accept personally identifiable information from a child under the age of 13 without a parents or guardians prior consent.

6. SECURITY PROCEDURES WE USE. We are very concerned with the security of your personally identifiable information and take great care in providing secure transmission of your information from your computer to our servers. Unfortunately, no data transmission over the Internet can be guaranteed to be 100% secure. As a result, while we strive to protect your personal information, we cannot guarantee the security of any information you transmit to us.

Once we receive your information, we take appropriate steps that we believe are reasonable to protect the security of your data on our system, both internally and from outsiders, and to ensure the integrity of the data we collect. We use a combination of technological and policy methods to protect this data.

7. Options

Opt-Out. We may periodically send you free newsletters and e-mails that directly promote our Services. When you receive such promotional communications from us, you will have the opportunity to “opt-out” (either through your Account or by following the unsubscribe instructions provided in the e-mail you receive). We do need to send you certain communications regarding the Services and you will not be able to opt out of those communications – e.g., communications regarding updates to our Terms of Service or this Privacy Policy or information about billing. Modifying Your Information. You can access and modify the PII associated with your Account through your Account settings or by contacting us at info@beerhereusa.com. If you want us to delete your PII and your Account, please contact us at info@beerhereusa.com with your request. We’ll take steps to delete your information as soon we can, but some information may remain in archived/backup copies for our records or as otherwise required by law.

8. CHANGES IN THESE TERMS.

We may change this Privacy Policy from time to time and will post notices on our Application at the time of any material changes to this Privacy Policy. Your continued use of the Application following the posting of changes to these terms will mean you accept those changes.
